The total area of a dwelling, including an apartment, is a very important digital indicator, on which the percentage of the owner's vote in the decision of the general meeting of tenants, the amount of payment for the maintenance and repair of housing, the cost of utilities and general house needs depend. Management companies and homeowners' associations do not always correctly determine the size of the total area of the dwelling. It is not difficult to check the correctness of the calculation of the total area yourself.

In accordance with Part 5 of Art. 15 of the Housing Code of the Russian Federation: "The total area of a residential premises consists of the sum of the area of all parts of such premises, including the area of premises for auxiliary use, intended to satisfy citizens' household and other needs associated with their living in a residential area, with the exception of balconies, loggias, verandas and terraces ".

If you are the owner of a dwelling, then you have a document certifying ownership - a certificate of state registration of rights. The total area of the dwelling is recorded in this certificate in the line "Object of law".

If you purchased or registered the rights to a dwelling after March 1, 2005, then the total area indicated in the certificate does not include the area of balconies and loggias.

If you purchased or registered the rights to a dwelling before the entry into force of the Housing Code of the Russian Federation (i.e. before March 1, 2005), the total area includes the area of balconies, loggias, verandas and terraces. If this (overestimated) size of the total area appears in the payment receipts, then it is necessary to confirm the current total area. To do this, you should obtain a new technical or cadastral passport for the apartment by contacting organizations that carry out technical inventory (for example, BTI). After receiving your passport, make a copy of it and attach it to the application addressed to the HOA or management company. The application must contain a requirement to replace the size of the total area with the one indicated in the newly received passport.

If you are the owner of a residential property, but until now, in the manner prescribed by law, you have not formalized your right, and have not received a Certificate of State Registration of Rights, then the only document certifying the right of ownership is a privatization agreement. However, it cannot be used as a basis for determining the actual total area. Therefore, you need to obtain a new technical passport and present it to the HOA.

If you live in a residential building on the basis of a social tenancy agreement, that is, you are a tenant, then you can confirm the current total area in two ways: by contacting the landlord, or by issuing a technical or cadastral passport yourself.
