Step 1

The provision of land plots owned by the city for rent to citizens and legal entities is carried out for a fee. Refusal to provide urban land for lease is possible only in the cases specified in the Land Code - when a plot is withdrawn from circulation, land is reserved for state or municipal needs. The provision of land plots for rent is carried out by the executive bodies of local self-government, which have the right to do so. In each city, these may be different bodies. For example, in Moscow it is the Department of Land Resources.

Step 2

There are two different algorithms for leasing a land plot: for construction and for other purposes. You can lease a land plot from the city for construction with or without prior agreement on the location of your facility. Without prior agreement, the site will be provided to you at the auction, and by agreement - according to the following action plan:

1. choice of a land plot (for this you need to submit an application to a specially designated body for this, in Moscow these are district councils).

2. Carrying out cadastral works.

3. registration of the site for cadastral registration.

4. making a decision on the provision of a land plot.

If a positive decision is made, then the conclusion of a land lease agreement and state registration of this agreement follows. Refusal to lease a land plot can be appealed in court.

Step 3

For purposes not related to construction, a land plot for rent is provided as follows: as in the above situation, the interested person first submits an application to the authorized body for the selection of the land plot, which will indicate the purpose of use, location and approximate dimensions of the plot. Then the authority approves and issues to the applicant the layout of the land plot, and the applicant, at his own expense, conducts cadastral work and puts the plot on cadastral records. A decision is made to lease a plot of land, a lease agreement is concluded and registered.

Step 4

If you own a building, structure or structure, then you have the exclusive right to acquire the right to lease a plot under such a building, structure or structure. If you are only one of its owners, and the plot below it is indivisible, then such a plot will be leased out with a plurality of persons from the tenant's side. This means that you will be one of the tenants. To acquire the right to lease a land plot, you should contact the municipal authority of the city with an appropriate application and documents established by this authority for such a purpose.
